Aurora, CO | Pit bull aficionados think they have a fighting chance to overturn the breed ban that took effect last year, but city officials say the ban is beyond legal challenge. "Once we have a trial in federal court the breed ban will be overturned," said Glen Bui, a representative for the American Canine Foundation.
The federal court proceedings have just gotten under way, but Bui thinks his organization can prove Aurora's ban on pit bulls and seven other breeds of "fighting dogs" is arbitrary and unconstitutional. City Attorney Charlie Richardson said there have been no court decisions in Colorado or elsewhere that would jeopardize Aurora's ban since it was adopted.
"We remain confident," Richardson said.
The ACF is involved in fighting breed-specific legislation in communities across the country and advocates laws that target irresponsible dog owners rather than a certain breed or breeds of dogs.
"Breed bans aren't going to solve the problem," Bui said. "This is not about American Pit Bull Terriers. There's 27 breeds of dogs being targeted by breed bans right now."

Supreme Court overturns anti-animal cruelty law in First Amendment case

The Supreme Court on Tuesday forcefully struck down a federal law aimed at banning depictions of dog fighting and other violence against animals, saying it violated constitutional guarantees of free speech and created a "criminal prohibition of alarming breadth."
The 8 to 1 ruling, written by Chief Justice John G. Roberts Jr., was a ringing endorsement of the First Amendment's protection of even distasteful expression. Roberts called "startling and dangerous" the government's argument that the value of certain categories of speech should be weighed against their societal costs when protecting free speech. ...[t]he court said the legislation passed by Congress was far too broad. Anyone who "creates, sells or possesses a depiction of animal cruelty" for commercial gain can be imprisoned for up to five years. A depiction of cruelty was defined as one in which "a living animal is intentionally maimed, mutilated, tortured, wounded or killed." It should be noted that as applied, children's cartoons, common tv shows, movies, books, magazines, and any and all depictions of animals potentially being harmed (even if not harmed, such as in movie actor animal scenes) --would violate this law as written. Although the law was specifically meant only for crush videos, in fact, the government had purposely applied it to historical video of dogfighting in the world, not crush films. The Humane Society of the United States basically wrote the law, then pushed to have it applied to the video (which was not a crush film.) Taken to an extreme, we assume it could apply to a fish on a hook.Roberts wrote that the definition was so loose that it could include all depictions of wounding or killing animals, even hunting videos or magazines.
